Holding the Municipality Liable
You can hold the municipality liable if you have suffered damage for which the municipality is responsible. For example, due to a defect in a public road, a public green space, or a vehicle owned by the municipality.
The municipality investigates and evaluates every claim for damages in accordance with the Civil Code. It is therefore important that you provide as much supporting documentation or statements as possible. Not only is your statement important, but so are the statements of others (if possible).
Your claim must include the following information:
- Your name, address, city;
- The incident, including the date, time, and exact location of the incident;
- Statement of Reasons (why is the municipality liable?);
- Any witness statements;
- Your contact information;
- Contact information for any witnesses;
- Photos of the situation and photos of the damage;
- Estimated amount of damages (with original invoices or receipts attached, if applicable);
- Any police report regarding the (vehicle) damage, including the following additional information:
- An original, signed accident report form;
- An expert report from a certified auto body shop;
- Address information for the insurance company;
- You must sign the liability statement and include your name.
