Applying for Compensation for Losses

You can use this form to submit a claim for compensation for damages caused by an action or decision of the Municipality of Moerdijk. This may include, for example, planning-related damages resulting from changes to the Environmental Plan, or damages resulting from your store being less accessible for an extended period due to roadwork. This compensation is also referred to as compensation for losses.

Compensation for damages does not cover damage caused by, for example, a loose sidewalk tile. This is damage resulting from a wrongful act by the municipality, and you can hold the municipality liable for this by sending a letter.

The purpose of this form is to ensure that the process proceeds as quickly as possible. We ask that you complete this form as thoroughly as possible and include all necessary attachments. The person handling this request may then contact you for additional information.

The legal provisions that form the basis for compensation for damages are Article 15.1 of the Environment Act and Article 4:126 of the General Administrative Law Act. These provisions stipulate that the administrative body (in this case, the municipality of Moerdijk) may, upon request, grant compensation to anyone who suffers or will suffer damage as a result of a cause specified in those articles. Only that portion of the damage that should not reasonably remain at the applicant’s expense will be compensated. Nor will the damage be compensated if it has already been compensated in some other way.

What is the threshold amount?

To process the application, you must pay a filing fee. Currently, the filing fee is €300. Once the form has been submitted and the filing fee has been paid, the process will begin. If the filing fee is not paid, the application will be declared inadmissible. This means that the application will not be processed. If the application is approved in whole or in part, you will receive a refund of the threshold fee.
