Objections and Appeals
If you disagree with a municipal decision, you may file an objection. Municipal decisions are made by or on behalf of the mayor and aldermen, the mayor, or the city council. The municipal decision will specify whether you may file an objection and what the procedure is for doing so.
An appeal must be filed with the municipality within six weeks after the decision is announced. The date of announcement is usually the date on which the decision was mailed.
There are two ways to file an objection.

After submitting your application, you can track its status online via My Moerdijk.
File a written objection
In your appeal, please state:
- your name and address
- the date
- the decision to which you are objecting
- the reason for your objection
- your signature

Please note: You cannot submit an appeal via email.
Good to Know
- After you have filed an appeal, you will receive a confirmation of receipt. This document explains the next steps in the process.
- The municipality of Moerdijk has appointed an independent appeals committee to advise the municipality on the decision to be made regarding the appeal. You will have the opportunity to explain your objections during a hearing held by the appeals committee. Any interested parties will also be invited to this hearing.
- Within a maximum of 12 weeks after the end of the 6-week objection period, you will receive a decision on your objection. In this decision, the municipality must take into account the recommendation of the Objections Committee. If, due to special circumstances, it is not possible to reach a decision on your objection within 12 weeks, you will be notified in a timely manner.
Interim Relief
If you file an objection to a decision, this does not mean that the decision is automatically postponed. The decision remains in effect until a ruling has been made on your objection. This may harm your interests—for example, because a building permit you are objecting to is simply carried out, or because a specific measure you have requested is not implemented. In such cases, you can request a preliminary injunction from the court’s judge for preliminary relief. You must do this at the same time you file your objection. The judge for preliminary relief may then, for example, rule that construction may not proceed for the time being.
You are required to pay court fees when filing a motion for a preliminary injunction.

Costs
There is no fee for filing an appeal with the municipality.
If you have retained an attorney or obtained another form of legal assistance, you will be required to pay the associated fees.
