Moerdijk Municipality Privacy Statement

The Municipality of Moerdijk processes personal data to carry out its legal and public duties. This statement explains how the Municipality of Moerdijk respects privacy.

The Municipality of Moerdijk processes personal data (and, in some cases, police data) for various purposes. The way in which we handle your personal data and police data is set forth in our internal Privacy Policy. In this document, the term “processing of personal data” also refers to the processing of police data pursuant to the Police Data Act (Wpg).

This statement provides additional information about how we handle your personal data and about your options for exercising your rights regarding personal data.

Due to new legislation or other developments, we regularly update our processes. This may also include changes to the way we process your personal data. We therefore recommend that you check this page regularly. This page is updated on an ongoing basis.

Applicable Laws and Regulations and Scope

Effective May 25, 2018, the General Data Protection Regulation (GDPR) applies to all processing of personal data. This European legislation has direct effect in the Netherlands. For matters that must be regulated at the national level, the GDPR Implementation Act applies in the Netherlands as a supplement. The person in charge

Each of the administrative bodies of the Municipality of Moerdijk is a data controller within the meaning of the GDPR for the processing activities carried out by or on behalf of the municipality. Our administrative bodies are:

  • the Mayor;
  • the Mayor and Aldermen (B&W);
  • the City Council.

Data Protection Officer

We have a Data Protection Officer (DPO). The DPO serves as an internal supervisor and advisor on the protection of personal data. The DPO has the following statutory duties:

  • to inform and advise municipal employees and officials on the requirements and obligations under privacy laws;
  • monitor whether the municipality complies with privacy laws and its own privacy policy. This also includes raising awareness about privacy;
  • provide advice on a data protection impact assessment (also known as a Data Protection Impact Assessment);
  • consult with the Dutch Data Protection Authority (AP).

Processing of Personal Data

The municipality of Moerdijk has statutory duties and obligations. In order to fulfill these duties and obligations, it is necessary to collect and use your personal data. For example, if you apply for a passport or move to the municipality, we will use your personal data in connection with those processes. We also process your personal data in connection with matters such as benefits, public safety, and healthcare.

We use various categories of personal data, primarily from residents and visitors to Moerdijk, such as name, date of birth, address, and/or location, as well as the Citizen Service Number and/or special categories of personal data when necessary. We collect and use this personal data for specific purposes that are aligned with our duties and obligations.

It depends on the specific processing activity which categories of personal data from which data subjects are processed and for what purpose we do so.

We place great importance on effectively protecting your personal data against misuse, loss, unauthorized access, and processing. To ensure this protection, we adhere to the following safeguards:

  • We process your personal data in a fair, lawful, and transparent manner, based on a legal basis for the processing of personal data;
  • We collect and use your personal data only for a specific and clearly defined purpose, and we use the personal data only for the purpose for which it was collected or for (compatible) purposes for which it is further processed, including scientific and historical research, archiving in the public interest, and statistical purposes;
  • We process your personal data only when necessary for the intended purpose;
  • We ensure that your personal data that is processed is accurate and updated as necessary;
  • We do not retain your personal data any longer than necessary. The necessity is determined by the purposes for which the personal data in question is used or for as long as necessary to comply with a legal obligation, such as for archiving or statistical purposes; and
  • We take appropriate technical and organizational measures to protect personal data, taking into account the state of the art.

Sharing Personal Information

To carry out our duties and responsibilities, we collaborate with partners outside our municipality. These may be other government agencies, but sometimes they may also be private entities. In certain cases, we share your personal data with these organizations. Whenever we exchange your personal data with other parties, we establish agreements that comply with applicable laws and regulations.

If your personal data is transferred to parties outside the European Economic Area (EEA), this will be done in accordance with legal requirements, such as establishing appropriate safeguards regarding the level of data protection in that country.

Profiling and Automated Decision-Making

For some of our tasks, it may be necessary to use profiles of individuals so that we can provide the appropriate care or take the appropriate actions. We are transparent about this (unless there are interests that preclude it) and will not make decisions based on those profiles in a fully automated manner. A staff member of our municipality will review such decisions first.

Exercising Your Rights

As a resident or interested party in our municipality, you may exercise your rights with us. This means that you may request access to the personal data (and police records) that we process about you.

You may also submit a request to correct or delete your personal data, or to restrict its use.

Finally, if your consent is the legal basis for the processing of your personal data, you may withdraw your consent and object to our processing of your personal data.

You can submit these requests by clicking the button below after logging in with DigiD or eIDAS. We will notify you within one month regarding the outcome of your request. Your request may not be granted in all cases. Both the GDPR and the Wpg specify situations in which your right may be restricted.
